Family offense petitions, emergency temporary orders, hearings, and defense for respondents in Suffolk County Family Court.

Orders of protection in Suffolk County Family Court

An order of protection can be the difference between safety and fear. It can also be weaponized in a custody fight and cost a parent access to home and children on a single affidavit. Beau Taylor Law, PLLC represents both petitioners seeking protection and respondents who have been served, with the same goal in every case: a fast, accurate hearing and an outcome that fits the facts.

Family offense proceedings

In Family Court, an order of protection is sought by filing a family offense petition against a spouse, former spouse, intimate partner, the other parent of your child, or a relative. The petition must allege a qualifying family offense, such as harassment, menacing, assault, stalking, or disorderly conduct. The court can issue a temporary order the same day the petition is filed, often without the other side present, and then schedule a hearing.

Family Court orders are civil. The same conduct can also be prosecuted criminally in District Court, and many Suffolk County families have both cases pending at once. The firm coordinates the strategy across both.

What an order of protection can require

  • Stay away from the home, workplace, school, or specific locations
  • Refrain from harassment, assault, menacing, or other offenses
  • No contact, directly or through third parties, including social media
  • Exclusion from the marital residence, even if the respondent owns it
  • Temporary custody and parenting time terms
  • Surrender of firearms and suspension of licenses
  • Payment of medical costs or property damage

If you need protection

Emergency applications are heard quickly. Bring any evidence you have: messages, photographs, police reports, medical records, and the names of witnesses. The firm can prepare and file the petition, appear with you for the temporary order, and present the case at the hearing. If there is an immediate danger, call 911 first.

If you have been served

Do not contact the petitioner, even to explain. A single text message can be a violation and a new charge. Read the order carefully, comply with it completely, and get counsel before the return date. A temporary order is not a finding that you did anything wrong, but a final order after a hearing can affect custody, your home, your firearms, your employment, and your record for years. These cases are won or lost on preparation and credibility at the fact finding hearing.

Violations

A violation of an order of protection is a serious matter and can result in jail. The firm files violation petitions for petitioners and defends respondents accused of violations, including where the alleged contact was initiated by the protected party.

Orders of protection and custody

Family offense petitions are frequently filed alongside custody and visitation petitions, and a finding of domestic violence is a factor the court must consider in deciding custody. Because the firm handles custody, support, and family offense matters together, you get one strategy rather than three.

Frequently Asked Questions

How fast can I get an order of protection in Suffolk County?
A temporary order can be issued the same day you file a family offense petition in Family Court, often without the other party present. A hearing on a final order is then scheduled.
Can I get an order of protection against someone I was never married to?
Yes, if you have a child in common, are or were in an intimate relationship, or are related by blood or marriage. Otherwise the remedy is generally through the criminal court.
What happens if I am served with a temporary order?
Comply with it fully and immediately, do not contact the petitioner, and retain counsel before the return date. You will have the opportunity to contest the allegations at a hearing where the petitioner must prove them by a fair preponderance of the evidence.
How long does a final order of protection last?
Up to two years in most Family Court cases, and up to five years where the court finds aggravating circumstances or a violation of a prior order.
Will an order of protection show up on a background check?
A Family Court order is a civil order and is not a criminal conviction, but it is entered into the statewide registry and may be visible to law enforcement and in some licensing contexts. A criminal court order or conviction is different. We can explain the consequences in your situation.
